Top reasons not to buy in a new subdivision

If you have bought or are planning to buy a new house in a new subdivision, a recent article in the New York Times entitled “Banks Foreclose on Builders with Perfect Records.” should be giving you sleepless nights. The article explains that banks have started getting tough with builders, even builders with excellent repayment records who have not missed a single payment. Like many other businessmen, builders rely heavily on Bank credit and any restrictions such as demands for extra collateral mean almost certain extinction for many builders. The article estimates that over 20,000 builders are out of business and the number is expected to rise to 50,000 which would mean that one out of every two builders in the USA can be expected to shut up shop.
Why should this development concern buyers or potential buyers? The truth is that most buyers buy or contemplate buying homes in subdivisions that are still being completed. The builder could go out of business at any time through no fault of his leaving the subdivision incomplete. No park or club as promised, or worse still a community of half-built houses. Your purchase price for a house in a new subdivision also factors in these surroundings, the community and the amenities offered. You don’t have to be a genius to see that resale values in a half-built subdivision would soon drop to rock bottom.
If banks are already so panicky that they are foreclosing on sound builders, the mind boggles at what they might do next. You can forget all the fancy sales talk and the community plans. If you have the slightest misgiving, don’t go ahead with the deal. But walk around the subdivision and judge the progress for yourself.
Other lesser reasons for not buying in a new subdivision are:
- Many of the features that you see in those beautifully appointed model homes are not included in the purchase price and you will have to pay for these upgrades. You would also have to repeatedly visit the builder to choose the materials for your floating and countertops and so on. Moreover, the builder would normally insist on an upfront payment towards these upgrades in addition to your normal earnest money deposit.
- A major expense to be incurred in new subdivision houses is the cost of landscaping the back had. The purchase price will normally cover only the landscaping in front and, if you are a little short of money, you will find yourself over looking an expense of dirt at the back of your house.
- Houses in the new subdivision and to have similar designs and look the same. Many people would consider that these houses lack charm and character. The lot sizes would also be much smaller than the lots in which old houses are situated.
- It may take a long time for the surroundings to be fully built and the amenities to be provided. It will also take years for the landscaping to take effect and in the meantime, you are surrounded by half grown trees and plants.

The Double Whammy: Foreclosure could result in tax liabilities

You have just lost your home when your lenders foreclosed, and out of the blue, to add insult to injury, you are hit with a tax demand. Unjust and unfair as this may sound, it can happen unless you clearly understand the tax implications of foreclosure. While some reliefs that have been provided by the Mortgage Forgiveness Debt Relief Act, not all foreclosed homeowners are benefited. The problem arises because under tax statute, a foreclosure is treated as a sale while debt forgiveness is treated as income. When your lender forecloses, he will issue to you a form 1099 C which will show that he has received the property and that you have received cash or other property. This will mean that the proceeds are taxable unless you qualify for an exception. Exceptions are, for instance, available if you have declared bankruptcy or if you are an insolvent
Let us take a little time to understand the taxation problem in detail. A foreclosure will be regarded as a sale at the Fair Market Value (FMV) of the house The difference between the FMV and the tax basis [which is defined as the cost of acquisition of the house plus the cost of any improvements] will therefore result in a capital gain or a capital loss as the case may be. In addition, if the lender cancels or forgives a part of the debt, as is quite a common these days, the amount so canceled is taxable as Cancellation of Debt (COD) income unless you are entitled to an exception. In the case of a capital gain you are allowed exclusion as federal home gain exclusion provided the home has served as your principal residence for two of the past five years.
For example, if your house is sold for its FMV of $500,000 and your tax basis is $300,000; your capital gain is $200,000. If the lender has forgiven you debt of $100,000, your taxable COD income is $100,000. In the absence of any exceptions, both the capital gains and the COD income are fully taxable.
The first problem is that in many cases, in the heyday of profligate mortgage lending, people often took out a second mortgage or a home equity loan on their principal residence to pay off high interest credit card debt. In many cases, the lender’s themselves would have required the borrower to consolidate or settle credit card debt This portion of the debt will not be included for the calculation of the tax basis since it was used neither for acquisition or for improvement. The second problem is that the relief only applies to the principal residence and second homes, vacation homes and investment properties do not qualify. So any debt for acquisition or improvement of any property other than the principal residence does not qualify for relief.
Even in the case of solvency or bankruptcy, you must be insolvent at the time of foreclosure or have filed for bankruptcy before the foreclosure takes place.
You must clearly understand that the purpose of this article is merely to alert you to the possible tax consequences of foreclosure. You should seek expert advice in your own individual case in order to establish the taxability or otherwise under both federal and state statute.

Sea, sea and sea

Last weekend I woke up earlier, because I was going to the sea. I had to pack all my staff in my bags. One of the most important things in my bag was my laptop. I was going with my parents so I din not have to worry about money, or transport as well. It was a long journey for all of us, but we where very happy because it is the favorite time of the year of for all of us. After about six hours we finally came to our destination. We were placed in a family house of our friends. After we left our staff we went on the beach. We where very excited. I left my towel on the beach and went into the sea. At the beginning it was little cold. But later it was great. Sea was perfect. I swim a lot. I dived, as well. And looking girls of course.

Screening potential tenants for your rental home

Once you have decided to rent out your house, one of the most difficult duties that you have to perform is to screen potential tenants so that you can be sure that you are getting all a good tenant or act the very least keeping out a bad one. You may be tempted to go by your instincts or gut feel but resist because:
- Your gut may not be a very good judge and
- Gut feel is not legal
It is important for you to be acquainted with the legal issues surrounding screening to avoid any unnecessary problems.
In the first place, you are allowed to gather where these kinds of information about your prospect of tenant such as employment history, references from previous landlords, details of income and evictions if any and credit history. You are also allowed to charge a screening fee to cover the cost of very fine information though it would be a good idea to reimburse the tenant should you go through with the rental. In the second place, you’ll be required to deal fairly with all tenants so it is a good idea to put your policy down on paper for instance how do you view past convictions or poor credit history or pets. Having made these rules follow them strictly so that you can demonstrate that there has been no discrimination in a particular rejection. How to save on your energy bills [and your taxes!] by tinting your windows

If you haven’t thought about tinting your windows with window tint or window film, here are many good reasons why you should think about it seriously. Window film, which can be from two to 7 mm thick, coexists of several layers of polyester film which is adhesive on one side and scratch resistant on the other side that will be exposed. It can be applied to glass or plastic. Depending on the film that you choose, the multiple advantages of tint are as follows:
UV protection: film blocks up to 99% off the ultraviolet radiation produced by sunlight. The traditional way of dealing with these problems has been to put up heavy curtains or drapes and cutting yourself off from sunlight. Film offers an elegant and cost effective alternative solution.
Disadvantages: there are some disadvantages to window film that you need to keep in mind

windows, the warranty may be voided by the use of window tint
- Damage such as a scratch is permanent and cannot be fixed

How to make life painless for yourself when moving with pets

Moving house can be a painful and disorientating experience for all of us but have you ever considered how traumatic it can be for your pets. Human beings have the capacity to understand and prepare for the experience but pets will often require extra care and affection. However with a little planning you can make it easier and we will outline the steps both before and after moving that can help.
Before moving:
Give yourself plenty of time before your moving date to make your preparations.

When this is the weather, one must dress the part. The air outside is frightful, staying cool and looking like the weather does not bother me is the objective of the day. The first thing to be done is to make sure my legs and arm pits are shaved. Let the deep tan of the summer radiate neatly. After applying gobs of sun block and looking smooth, I first choose my favorite pair of short denim shorts. A lightweight sports bra that wicks away perspiration is next order of business. A light color tank top in yellow is the one I chose today. Slip on a pair of yellow birkenstocks and I am ready to go and battle today’s weather. Slipping on the Serengeti sunglasses and I am off for the day.
How to avoid home repair scams

The statistics show that many common consumer complaints relate to home repair and improvement. These complaints generally have to do with contractors taking payment and not doing their job, contractors doing a shoddy and substandard job and contractors conning you into expensive and unnecessary work. The very number of these complaints suggest that there are a fair number of crooked contractors out there and why you should be extra careful when considering repair or an improvement to your home .
I think it is fair to assume that the average homeowner has little or no technical knowledge about home repair and is thus fair game for the con man. This situation can be compounded by an emergency such as flooding or storm damage when panic sets in and the first priority is to get the house fixed. Here are some common sense precautions for when you are vulnerable.
1) Take calm and considered decisions. I know this is difficult when you are in a panic and desperately worried about the flooding in your house or whatever your problem is. Take your own equivalent of a deep breath and count to 10. The emergency has already occurred so don’t make it worse by on handing over your money to a crook. Do your homework carefully on any prospective contractor and try and check them out in detail. When you consider the time, money and effort you are going to expend chasing after a crook, you will agree that a fraction of this effort checking them out in the first place is well worth the investment.
2) Deal with licensed contractors. As far as possible negotiate only with contractors possess a valid license. The license will provide some reassurance and, in many places, you will also be entitled to a measure of consumer protection. If you require expensive repairs make sure you get quotations from two or three contractors. Beware the contractor who offers to “fix” your insurance or FEMA claim in return for getting the job. Either your claim is valid or it is not, and in the latter case, any misleading or fabricated information given to the insurance company at the behest of the contractor could invalidate your insurance altogether and even involve you in criminal proceedings.

I had the BEST Hawaiian style Beef Stew

Last night I had the best Hawaiian Curry Beef Stew. It is similar to the Indian Curry that is used in Indian stew. The stew consist of beef chucks boiled in a slow simmer to insure tenderness. I also add vegetables which include but not limited to carrots, celery and potato. Can WE say YUMMY? I boil the beef for a good hour of so. I then add in the Curry mix to taste my family likes it a little spicy. I then add in the potatoes and simmer it with the beef for a good a 20 minutes. After, I add all the other vegetables in for another 20 minutes. I think that the whole process takes a good hour and a half and is truly worth the wait. So that is what I had for dinner and leftover are even better the next day.
